Our company Watchedflix, a.s., with its registered seat at Štefánikova 94/4, 917 01 Trnava, Slovak Republic, ID number: 50 977 661 (hereinafter referred to as “We”, “Us”, “Our”) is processing your personal data for the purpose and legal basis as specified below in this privacy notice.
We are the data controller, which means that we determine the purposes and means of the processing of your personal data.
We take the protection of personal data very seriously, therefore you will find here all the information about the processing of your personal data by Us as well as the information on your rights. We implement high standards of data security (organisational and technical) so your data are not disclosed to unauthorised recipients or third parties.

1. PERSONAL DATA WE COLLECT AND PROCESS
We collect your personal data you provide to us voluntarily, mainly by filling out the registration form, by using the Watchedflix services, including the Watchedflix social network service or using our customer service. We process your:
identification details (name, surname);
contact details (email, country/habitual residence);
economic data (payment method, payment transaction information, bank account, credit card number);
account profile picture/photo (the picture/photo you upload in your account profile);
user account data (clicks, reviews, group memberships, account settings/preferences);
other personal data (all other personal data you provide us voluntarily within the communication with Us and/or providing them within the Watchedflix social network service).
We also collect your personal data from other sources, which include:
digital data (IP address, geo-location data) from service providers to improve Our Watchedflix services or to customise the Watchedflix services pursuant to Our Terms and this Privacy Notice;
economic/financial data (payment method, payment transaction information, bank account, credit card number) from the payment service providers to process the payments received from you under our Terms and concluded agreements;
digital data from social networks (e.g. Facebook);
publicly available data at public state databases or registers.
We do not process any special categories of personal data (sensitive data), unless it is required by applicable law or the law will specifically entitle us to process such data for a specific (necessary) purpose in the future.
Our web servers by default temporarily protocol data of requesting computers that visit our websites, identification information concerning the web browser and operating system used at each visit and the duration date and duration of the visits. These data cannot be used to identify a specific natural person, therefore they are not personal data.
Our Watchedflix website uses cookies so that Our website is fully functional and you can fully experience its features. 2. WHY DO WE HAVE YOUR PERSONAL DATA AND WHAT IS THE BASIS FOR YOUR PERSONAL DATA PROCESSING
We process your personal data for the following purposes and on a relevant legal basis:
providing the Watchedflix services – which involves processing your personal data to provide you all the Watchedflix services (including the Watchedflix social network service) and to perform the general agreement and individual agreements on providing the access to digital content concluded by and between you and Us pursuant to our Terms.
In order to improve and develop our Watchedflix services, we collect and analyse data generated on the Watchedflix website (your activity within the Watchedflix service), such as which movies (films) you click on, search, purchase, watch, review, we determine your general geographic location and information regarding your computer or device you use to access our Watchedflix service. This feature is an integral part of our Watchedflix services so that the Watchedflix service is able to personalize your user experience, e.g. by suggesting movies to watch, people to follow or groups to join.
We will process your IP address or other geo-location data to prevent any abuse of Our Watchedflix services or to restrict access to certain digital content, whereas some works (films/movies) provided by our Watchedflix services may be restricted to specific countries/regions. This will not lead to geo-blocking within the EU internal market prohibited under the applicable EU law.
We need to process your personal data for this purpose for the entire duration of the agreements and after the agreements expire or are terminated, we archive the personal data to the extent necessary to comply with Our legal obligations under the applicable law (accounting and tax regulations stipulate 10 years storage period).
to improve Our services and products – which involves processing your personal data to improve Our services and/or products and provide you with the support you will need in relation to our services and products. We have a legitimate interest to such processing of your personal. This purpose includes updating and developing profiles, developing and improving the service and user experience, customizing your service experience, responding to your comments and questions and providing the user support, sending you related information (updates, security alerts and other support messages), receiving error messages about any issues you/your device encounters with our services to enable us to fix bugs and interoperability issues, detecting and preventing illegal activities (e.g. hacking), conducting optional user feedback and conducting research.
You have a right to object to processing of your personal data for this purpose at any time and if you object to such processing, We will no longer process your personal data for this purpose unless We demonstrate compelling legitimate grounds for the establishment, exercise or defence of Our legal claims.
We will store your personal data for this purpose for the duration of the agreement concluded by and between you and Us and up to five (5) years after the agreement was expired or terminated.
keep you up to date with Watchedflix news (direct-marketing purpose) – which involves sending you email newsletters about Our Watchedflix services, blogs and products and to keep you up to date with the Watchedflix news and updates. We process your personal data based on Our legitimate interest.
If you are Our previous or current user/client, We are entitled to process your personal data for this purpose without your consent based on Our legitimate interest. We have a legitimate interest to stay in touch with our users who currently use or used in the past our Watchedflix services or products and we intend to promote our services, blogs and products so they continue to use our Watchedflix services or products or so they return to Us to use our Watchedflix services or products again. You have a right to object to processing of your personal data for this direct-marketing purpose at any time and if you object to such processing, We will no longer process your personal data for this purpose. You may use the right to object by using Our contact details or Our email: privacy@Watchedflix.com. You may also unsubscribe from our newsletter clicking on the unsubscribe link in the newsletter email and We will stop sending you this type of newsletter.
We will store your personal data for this purpose for the duration of the agreement concluded by and between you and Us and up to five (5) years after the agreement was expired or terminated.
other marketing purposes – which involves (i) promotions and news of new movies/films and content from various producers and authors, (ii) promotions and news of various festivals, happenings and other events of third parties, (iii) or other purposes for which you give Us the consent to process your personal data. We process your personal data for this purpose (purposes) based on your consent you have given us voluntarily. You have the right to withdraw your consent at any time by using Our contact details or Our email: privacy@Watchedflix.com. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
We will store your personal data for the duration of the consent.
performance of the contractual obligations and keeping accounting/contractual records – for this purpose We process the personal data related to our business partners, contractors, subcontractors so We can perform the contracts concluded by and between Us and them. We need to process the personal data for this purpose for the entire duration of the contracts and after the contracts expire or are terminated, we archive the personal data to the extent necessary to comply with Our legal obligations under the applicable law (accounting and tax regulations stipulate 10 years storage period).
establishment, exercise or defence of Our legal claims – We process the personal data for this purpose based on Our legitimate interest to establish, exercise or defend Our legal claims in courts, extrajudicial proceedings, arbitration, administrative proceedings, decision enforcement proceedings, bankruptcy and restructuring proceedings, in relation to users, clients, business partners and/or debtors. We have a legitimate interest to process the personal data for this purpose to effectively establish, exercise or defend Our legal claims. You have a right to object to processing of your personal data for this purpose at any time and if you object to such processing, We will no longer process your personal data for this purpose unless We demonstrate compelling legitimate grounds for the establishment, exercise or defence of Our legal claims.
We store the personal data for this purpose for the duration necessary, to effectively establish, exercise or defend Our legal claims. The storage period mainly corresponds with the statutory periods/limits to effectively establish, exercise or defend Our legal claims at the court, whereas the storage period should not exceed four (4) years after the contractual/non-contractual relationship expired or was terminated.
establishing contact, communication or providing information – We process the identification and contact details of natural persons and of the representatives of the legal persons collected from publicly available sources for this purpose or collected from these person, as well collected from other persons for this purpose, based on Our legitimate interest. We have a legitimate interest to establish contact with other natural and legal persons to properly establish contact and communicate with them for the proper/basic operation of Our company or to provide these persons with information they require (e.g. by using our contact forms or by emailing us). You have a right to object to processing of your personal data for this purpose at any time and if you object to such processing, We will no longer process your personal data for this purpose unless We demonstrate compelling legitimate grounds for the establishment, exercise or defence of Our legal claims.
We store personal data for this purpose for the duration necessary to establish contact, communication or provide the information required, whereas the storage does not exceed five (5) years.
3. THE RECIPIENTS OR CATEGORIES OF RECIPIENTS OF THE PERSONAL DATA
Your personal data may be disclosed to the following recipients however before we disclose any personal data we thoroughly assess whether We are entitled to disclose the personal data to the recipients:
We use HotJar and UXCam. These services may record: Screens visited, Interaction patterns (such as screen actions, gestures: taps, scrolls) and Device details (Type, Version, Model, Operating System). We are using the information collected by HotJar and UXCam to improve our apps and websites. These services do not collect personally identifiable information and do not track your browsing habits across apps or websites. Our Watchedflix project is running on servers operated by Google Cloud Platform Servers/Storage and Amazon Web Services Servers/Storage (processors). For more information on their data protection please see Google Trust & Security or Amazon;
We use Google Tag Manager to run other marketing scripts on our website (e.g. Facebook Pixel or Google Ads conversion or retargeting codes), Google Ads Conversion Tracking (the data are sent to Google Ads after conversion), Google Ads Remarketing Tag (by targeting users with cookie – retargeting the user within the Google ad network) and Google Analytics (collects data about using our Watchedflix website, mainly to measure traffic and event like clicks, purchases etc.). We use MailGun (processor) to process the user’s Emails for registration verification, password reset and the issue of invoices. For more information on MailGun data protection please see their GDPR Compliance;
We use Sendinblue (processor) for handling the distribution of emails and newsletters. For more information on Sendinblue data protection please see their Security;
We use Facebook Pixel which helps Us to track your conversions from Facebook ads, optimise ads, build targeted audiences for future ads and remarket to users/persons who executed various actions on the Watchedflix website. For more information on Facebook data protection please see the their Privacy Policy;
to IT companies (processors) which provide Us with our daily internal IT support and management;
to our lawyers (law firms) who provide Us with complex legal services and represent Us in courts or at other state authorities to exercise or defend Our legal claims;
to our auditors (processors) who perform audits within our company, for example, to audit Our financial statements;
to interpreters and translators (processors) if We in relation with the provision of Our services or for some other purpose We need to translate documents or texts to or from a foreign language;
to accountancy firms and tax advisers (processors) who provide Us complex accounting and tax services;
to PayPal and Adyen which operate as payment processors for Us to transfer and receive funds from or to our users/clients for using our Watchedflix services. For more information see PayPal Privacy Policy and Adyen Privacy Policy.
We have concluded contracts with our processors, so they are not entitled to do with your personal data anything, unless we instruct them to do so.
We may also provide or disclose your personal data to any competent law enforcement body, regulator, government agency or other third party where we believe disclosure is necessary:
as a matter of applicable law or regulation; or
to exercise, establish or defend Our legal rights; or
to protect your vital interests or those of any other person.
We will also provide the producers, authors and/or studios of the movies/films (which are accessed via the Watchedflix services) with the data analytics concerning the movies/films. This involves the statistical and analytical data on how many times the users clicked on the specific movie/film and purchased them, how are the movies/films rated and reviewed by the users. Before we disclose these data to the producers, authors and/or studios, these data are anonymised so that they are not connected with a specific user. Producers, authors and studios use these statistical and analytical data to get feedback on their movies/film, to determine, which of their movies/films are popular so they can decide if they will continue to provide these movies/films via the Watchedflix services, or decide if they provide or even produce more of their movies/films etc. These data will provide the producers and authors with the feedback they need to bring more content on the Watchedflix project.
Some of the digital content is provided to the users at our Watchedflix project via the AVOD method. AVOD is an advertising-based video on demand service which provides specified digital content to the users for free and the digital content contains ads selected by the respective ad providers. Due to the core functionality of the AVOD service, we provide the ad providers with your IP address (only to identify your region, country and/or city), IDFA, AAID and the specification of your device you are using to access the AVOD digital content (e.g. operating system and brand of the device). Based on these basic data the ad providers are able to display the suitable advertisements, commercials and/or promotions within the digital content while you access (watch) the digital content. This enables us to provide you with the digital content for free. We do not provide the ad providers with your other data we have at our disposal (such as your account information data or email address) so that the ad providers and their partners are not be able to directly identify you. The current ad provider for the AVOD digital content is the Select Media.
4. SOCIAL NETWORKS
Facebook:
Watchedflix uses plugin of the social network facebook.com operated by Facebook Inc., 1601 S. California Ave, Palo Alto, CA 94304, USA ("Facebook"). Facebook plugin is used for login to Watchedflix platform via your Facebook account. On our platform, there is the possibility to “share to Facebook”, which will redirect logged user to Facebook and allow him to share content page (movie page) from Watchedflix on his Facebook wall. Even if you are not registered on Facebook, Facebook may nonetheless learn and save your IP address.

If you are registered on Facebook and do not want Facebook to collect data on you through our website and link it to your member data saved by Facebook, you must log out of Facebook before visiting our website. You may also block Facebook plugins through according browser add-ons, e.g., "Facebook Blocker." You may also prevent Facebook plugins through browser add-ons, e.g., the script blocker "NoScript" (http://noscript.net/).
5. DATA TRANSFER OUTSIDE EU / EEA COUNTRIES
It is possible that we may transfer your personal data to third parties outside EU / EEA countries where the European Commission did not decide that there is an adequate personal data protection (e.g. the USA). Before such a transfer we will ensure that the recipient meets the adequate personal data protection (e.g. by concluding the standard data protection clauses adopted by the European Commission, supervisory authority or the third party is actively certified by the EU-USA Privacy Shield)
6. CHILDREN
You must be at age 18 or older to create a Watchedflix account and to use Our Watchedflix services. Some countries set the age of majority to persons who are older than 18 years. Persons who are under the age of majority are entitled to use the Watchedflix services only under a strict supervision and approval of their parents or legal guardians.
7. YOUR DATA PROTECTION RIGHTS
You have the right to access, correct, update or to delete all of your personal data. We will consider your request in accordance with the applicable laws. If the EU General Data Protection Regulation (GDPR) is applicable, you have the following data protection rights:
Right to access: You have the right to know if We process your personal data, which data we process about you, for what purposes, for how long, where do we obtain your personal data, to whom we transfer them, who else processes your personal data, if an automated decision-making or profiling in relation to your personal data is performed and what other rights associated with the processing of your personal data you have. Every information you can find is in this Privacy Notice. If you are not certain which personal data we process about you, you can ask us to confirm whether personal data that concern you are or are not processed by us, and if so, you have the right of access to such personal data. As part of your right of access, you can request a copy of your personal data processed, the first copy of which is provided free of charge and additional copies are subject to a fee.
Right to a rectification: If you find out that the personal data that We process about you are inaccurate or incomplete, you have the right to have them rectified or completed, as the case may be, without undue delay.
Right to erasure (‘right to be forgotten’): In the following situations, you have the right to request that We erase your personal data. We will erase your personal data without undue delay if any of the following conditions is fulfilled:
we no longer need the personal data for the purposes for which we processed them;
you withdraw your consent to the processing of personal data and we do not have another reason for any further processing of the personal data;
you believe that the processing of personal data carried out by us is no longer in compliance with generally binding legislation;
the personal data must be erased for compliance with a legal obligation pursuant to applicable law.
Please note that if one of the conditions is met, it does not mean that we will erase all your personal data immediately. This right will not apply in the event that the processing of your personal data continues to be necessary to comply with Our legal obligations or to establish, exercise or defend our legal claims.
Right to restriction of processing: In certain situations, in addition to the right of erasure, you can exercise the right of limitation on processing of your personal data. This right allows you to request in certain situations that your personal data are tagged and such data are not be subject to any further processing operations - however, not forever in this case (like in the event of the right to erasure), but instead for a limited period of time. We have to limit the processing of personal data when:
you challenge the accuracy of personal data until We identify which data are correct;
We process your personal data without a sufficient legal basis, but you prioritize their limitation over erasing such data (e.g. if you expect that you would provide such data to us in the future anyway);
We no longer need your personal data for the aforementioned purposes of processing, but you require them for the establishment, exercise or defence of your legal claims; or
you object to the processing; the right to object is described in more detail below – „Right to object”). For the duration of the investigation of the legitimacy of your objection, we are required to limit the processing of your personal data.
Right to data portability: You have the right to receive all your personal data from Us that you provided to Us and we process your personal data on the basis of your consent or on a contract/agreement. We will provide your personal data to you in a structured, commonly used and machine-readable format. In order to be able to easily transfer data at your request, this can only include the data that we process in our electronic databases using automated means.
Right to object: You have the right to object to processing in the event We process the personal data based on the legitimate interest. If you object to processing your personal data based on the legitimate interest We will no longer process the personal data unless We demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms or for the establishment, exercise or defence of Our legal claims.
Right to withdraw your consent: Giving a consent is voluntary. In the event you have given Us a consent to process your personal data, you have the right to withdraw your consent at any time. The withdrawal of consent shall not affect the lawfulness of processing based on consent before its withdrawal.
How to exercise your rights: (under GDPR) You can exercise your rights using Our contact details, by email at: info@Watchedflix.com or you can use our online form at: www.Watchedflix.com. We will provide you with the information on the actions taken on your request without undue delay, no later than one (1) month from receipt of your request. If We have reasonable doubts about your identity, We may ask you to provide additional information to confirm your identity (for example, We may ask you to provide a copy of your ID card). The time limit for processing your application begins to run after We have verified your identity. Due to the complexity of the application or the greater number of requests, we may extend the period in question by a further two (2) months, whereas We will inform you about this period extension.
If We do not take action on your request, We will inform you without delay and at the latest within one (1) month of receipt of the request of the reasons for not taking action and on the possibility of lodging a complaint with a supervisory authority and seeking a judicial remedy.
If your requests will be manifestly unfounded or excessive, in particular because of their repetitive character, We may refuse to act upon your request or request from you a reasonable fee taking into account the administrative costs of providing the information or communication or taking the action requested. We will consider a request as an inadequately repeated request, a request which is identical or similar and filed within six (6) months of the submission of the previous request.
The right to lodge a complaint with a supervisory authority: The exercise of rights in the manner described above does not affect your right to lodge a complaint with the relevant supervisory authority. You can exercise this right mainly if you believe that We process your personal data without authorization or in violation of generally binding legislation. You can lodge a complaint against the processing of personal data by Us with a data protection authority, in particular in the European Economic Area member state of your habitual residence. We may update this Privacy Notice occasionally in response to changing legal, technical or business developments. When we update our Privacy Notice, we will take appropriate measures to inform you, consistent with the significance of the changes we make. We will obtain your consent to any material Privacy Notice changes if and where this is required by applicable data protection laws. If you will not agree with the updates in our Privacy Notice you can cancel to use the Watchedflix services or delete your Watchedflix account at any time.
